Terms of Service

These Terms of Service (“Terms”) govern access to and use of the StawiHR platform and related services (the “Service”) provided by Stawitech Solutions (“Stawitech”, “we”, “us”). By registering, subscribing, or using the Service, you agree to these Terms.

1. The Service

StawiHR is a cloud-based human resource and payroll management system. Features may include employee records, attendance, leave, payroll processing, reporting, and integrations depending on your subscription plan.

2. Accounts and eligibility

You must provide accurate registration information and keep credentials confidential. You are responsible for all activity under your account. The Service is intended for lawful business use by organisations and their authorised users.

3. Subscriptions and payments

Paid plans are billed according to the package selected at signup or renewal. Trials, where offered, convert to paid subscriptions unless cancelled before the trial ends. Payments may be processed via M-Pesa, card gateways, or bank transfer as made available. Fees are non-refundable except where required by Kenyan law or expressly stated in writing.

4. Customer responsibilities

As the subscribing organisation, you are responsible for:

  • Lawful collection and use of employee data entered into the Service;
  • Maintaining appropriate internal policies and employee notices;
  • Ensuring payroll and statutory filings meet local requirements (we provide tools; you retain compliance accountability);
  • Backing up critical exports where your policy requires offline copies.

5. Acceptable use

You may not misuse the Service, attempt unauthorised access, interfere with other users, upload malware, or use the platform for unlawful purposes. We may suspend access for material breaches after notice where practicable.

6. Intellectual property

Stawitech retains all rights in the Service, branding, and documentation. You receive a limited, non-exclusive licence to use the Service for your internal business operations during an active subscription.

7. Availability and support

We aim for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated when possible. Support channels and response times depend on your plan.

8. Limitation of liability

To the fullest extent permitted by Kenyan law, Stawitech is not liable for indirect, incidental, or consequential damages arising from use of the Service. Our aggregate liability is limited to fees paid by you for the Service in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate according to the subscription agreement. Upon termination, access may be disabled and data handled per our Privacy Policy and your data export requests.

10. Governing law

These Terms are governed by the laws of the Republic of Kenya. Disputes shall be subject to the exclusive jurisdiction of Kenyan courts unless otherwise agreed in writing.
